1. About These Terms

These terms govern your use of DocuTenant ("the Service"), operated by Gudgie Digital Ltd (SC880840), 18 Young St, Office 305, Edinburgh EH2 4JB ("we", "us", "our"). By creating an account, you agree to these terms.

2. What the Service Does

DocuTenant is a document generation tool for UK private landlords. It generates documents from templates and AI-assisted content based on information you provide. It also provides a compliance dashboard for tracking certificate expiry dates.

3. Important Disclaimer — Documents Are Guidance, Not Legal Advice

This is the most important clause in these terms.

DocuTenant documents are professionally drafted and regularly updated to reflect current UK legislation. However:

  • Documents generated by DocuTenant are provided as guidance only and do not constitute legal advice.
  • We are not a law firm and do not provide legal services.
  • We strongly recommend that you have critical documents (particularly tenancy agreements, eviction notices, and deposit documentation) reviewed by a qualified legal professional for your specific circumstances.
  • We do not guarantee that any document generated by the Service is legally compliant in your specific situation. Legislation varies by jurisdiction, and individual circumstances may require tailored legal advice.
  • AI-generated content (property listings, welcome packs, inspection reports, reference letters, contractor instructions, and checkout reports) is produced by artificial intelligence and should be reviewed for accuracy before use.

You are solely responsible for verifying the accuracy and legal suitability of any document you generate and use.

4. Beta Status

DocuTenant is currently in a private beta testing phase. This means:

  • Features may change, be added, or be removed without notice
  • You may experience bugs or errors
  • We welcome your feedback to improve the service
  • We make no guarantees about service availability during the beta period

5. Your Account

  • You must provide accurate information when creating your account
  • You are responsible for maintaining the security of your account credentials
  • You must not share your account with others
  • You must be at least 18 years old to create an account
  • We may suspend or terminate accounts that violate these terms

6. Acceptable Use

You agree to:

  • Use the Service only for its intended purpose (generating landlord documents and tracking compliance)
  • Provide accurate information when generating documents
  • Comply with all applicable UK laws, including landlord and tenant legislation, data protection law, and anti-discrimination law

You agree not to:

  • Use the Service for any unlawful purpose
  • Enter false or misleading information into document templates
  • Attempt to access other users' data
  • Reverse-engineer, copy, or redistribute the Service or its templates
  • Use automated tools to access the Service (scraping, bots, etc.)
  • Resell documents generated by the Service as a commercial document drafting service

7. Intellectual Property

  • Document templates, system prompts, and the application code are our intellectual property
  • Documents you generate using the Service are yours — you own the output and may use it freely
  • Your data (property details, tenancy information) remains your property at all times
  • The DocuTenant name, logo, and branding are our trademarks

8. Data Protection

We process personal data in accordance with UK GDPR. See our Privacy Policy for full details on what data we collect, how we use it, and your rights.

You acknowledge that by entering tenant personal data (names, contact details) into the Service, you are acting as a data controller for that data. You are responsible for ensuring you have a lawful basis to process your tenants' personal data and for complying with your obligations under UK GDPR as a data controller.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranty of any kind, express or implied
  • We do not warrant that documents generated by the Service are legally compliant, error-free, or suitable for any particular purpose
  • We are not liable for any loss, damage, or legal consequences arising from your use of documents generated by the Service
  • Our total liability to you for any claim arising from the Service is limited to the amount you have paid us in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or incidental damages including (but not limited to) loss of rental income, legal costs, fines, penalties, or failed possession proceedings

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Service Availability

  • We aim to keep the Service available but do not guarantee uninterrupted access
  • We may suspend the Service for maintenance, updates, or other operational reasons
  • We are not liable for any loss caused by the Service being temporarily unavailable

11. Subscription and Payments

  • Free tier users are subject to usage limits as described on the Service
  • Paid subscriptions are billed monthly
  • We may change pricing with 30 days' notice
  • You may cancel your subscription at any time
  • No refunds are provided for partial months

12. Termination

  • You may delete your account at any time through the Settings page
  • We may suspend or terminate your account for breach of these terms
  • On termination, your data will be deleted in accordance with our Privacy Policy

13. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the email address on your account at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
